    This monsoon, RTO may crack down on auto fare refusals Many Mumbaikars complained of fare refusals by autorickshaw drivers during the pre-monsoon showers on Saturday evening, and experts feel this could just be a precursor to the ‘harrowing time’ road commuters can expect during rains. A senior RTO official said the department is likely to launch a fresh drive to curb refusals during monsoon. Commuters’ problems are expected to compound with poor frequency of BEST buses and kaali-peeli taxi population dwindling over the past few months. “We have found that 5-10% auto and taxi drivers refuse fare. Nearly 90% of them are proved guilty as we also have the complainants’ mobile numbers and summon them as witness during hearings, ” said a deputy transport commissioner. RTO sources said every year, 60% of the complaints against auto and taxi drivers are about fare refusals, and a maximum of them are during the monsoon months —June and September. Statistics show that over 15, 000 complaints were registered against errant auto-taxi drivers at the four RTOs in the city in past seven years, and the most common grouse was fare refusal. Saturday evening saw long queues at bus stops outside most railway stations as the BEST bus frequency was poor and automen refused to ply commuters. “I got drenched as I five auto drivers refused to go to my destination, ” complained Rohan Gaikwad, who lives in the eastern suburbs. Same was the case for aggregator cabs as they were few in numbers. “Auto drivers who refuse passengers and leave them stranded in the rain should be imposed with penalty and their permit/licence should be suspended, ” demanded transport activist G R Vora. But automen claim that they refuse passengers only in case of personal emergency. “We refuse commuters if we have to take a lunch break, fill fuel or go home after a shift, ” said an auto driver. As for BEST buses on road, statistics show the fleet size has reduced from 4, 200 a few years ago to 3, 300. “In the name of cost-cutting, the BEST has discontinued several routes, ” said transport analyst Hussain Indorewala.     Mumbai RTOs not ready with test tracks; deadline ends in April  The Bombay HC, in its order, had clearly stated it won’t grant an extension for making the test tracks. None of the four regional transport offices (RTO) in the city are ready with the 250-metre brake test tracks required to conduct vehicle fitness tests, although the deadline set by the Bombay high court (HC) ends this month. On September 14, while hearing a public interest litigation (PIL) filed by Pune-based whistleblower Shrikant Karve, the HC had directed the transport department to stop conducting vehicle fitness tests on open roads by April-end. The HC, in its order, had clearly stated it won’t grant an extension for making the test tracks. It had warned that if the tracks are not ready within six months, it might stop brake tests or renewal of fitness certificates. Although not in Mumbai, the transport department did manage to get test tracks ready in other parts of the Mumbai Metropolitan Region (MMR). On Sunday, the department is going to inaugurate the track of the Panvel RTO at Taloja, in the presence of transport minister Diwakar Raote. In case of commercial vehicles, one with the yellow number plates, fitness tests are conducted annually, except for newly registered ones. New vehicles have to renew their fitness certificate two years after registration while private vehicles, one with the white number plates, have to do so after 15 years. The Tardeo RTO has been conducting vehicle fitness tests in its office premises, on a testing track of less than 100 metre. Andheri RTO and Wadala RTO have been conducting the tests on open roads, while Borivli RTO has been doing so on a rented BEST plot. According to RTO officials, the Tardeo RTO had sought the land of Aarey dairy at Worli sea face for the test track, while Wadala RTO had requested for itsdairy land at Kurla, besides a government land at Mulund. Borivli RTO and Andheri RTO had sought lands adjacent to Aarey road in Goregaon and near the Versova cemetery, respectively. Apart from Andheri, the government has not allotted the land to any other RTO in Mumbai. A senior RTO official said, “The government issued a notification about the allotment of land to RTOs months ago, but the files are still pending at the collector’s office, ” he said, requesting anonymity.     IF YOU ARE IN AHEMEDABAD AND HAVEN'T GOT YOUR RC BOOK YET? VISIT RTO ASAP ON MAY 20, 2018 If you have been issued a vehicle registration certificate book in the past three months but have not received it due to some reason, visit the Sabarmati RTO on May 20 between 11 am and 4 pm. The RTO is holding a camp to distribute around 25, 000 RC books that had been sent by post to vehicle owners, but have returned to the RTO due to wrong addresses or other reasons.  The RTO had dispatched more than 1 lakh RC books after updating names, addresses and other detail during the period. This is the first time that such a camp is being organized for the public.  Regional Transport Officer (Ahmedabad) S P Muniya said, "RC books of newly registered vehicles are dispatched after verifying and updating names, addresses and other details. Over 25, 000 RC books were returned to the RTO in past three months because of reasons like change of address, closed houses or wrong addresses among others. We have decided to organize a camp on May 20 to hand over RC books to vehicle owners as resending RC books to addresses from where they have been returned makes no sense. We are aware that 25, 000 is a large number and decided to allot a Sunday so that owners can collect their RC books at their convenience." Vehicle owners who have not yet received their RC books can walk in with a copy of Aadhar card, voter ID or other photo identity and address proof and collect them.     Vehicle Registration Vehicle registration is compulsory to drive motor vehicle. No owner of a vehicle can allow or permit the use of unregistered vehicle. No dealer of motor vehicle can deliver unregistered vehicle to the purchaser. Vehicle is registered with Regional Transport Officer (RTO). There are three types of registration with RTO. They are as cited below: Temporary Registration Registration of New Vehicle Registration of vehicle arrived from outstate or assignment of new registration mark (R.M.A) Let us discuss the above three separately: Temporary Registration To take vehicle from the dealer's premises, it needs a temporary registration. In case of non-transport vehicles, to take the vehicle to the place of registration from the dealer's premises it needs to be registered temporarily. In case of transport vehicle one needs a time to construct the body of vehicle over the chassis hence it needs a temporary registration. Temporary registration is valid for 7 days initially and can be extended up to 30 days incase of non transport vehicles. The validity can be extended for some more period with the permission of registering authority in case of transport vehicles. An application for temporary registration shall be made. Registration of New Vehicle To apply for the permanent registration of new vehicle, it should be produced to the RTO for inspection. The vehicle is inspected by an inspector who confirms to the provision of Act & rule and then the vehicle tax is recovered. Along with this the following is to be submitted: Form -20 Sale certificate in form 21 given by dealer. Roadworthiness certificate in form 22 , 22-A from the manufacturer. Roadworthiness certificate in form 22-A part II from the body builder for transport vehicles. Transport commissioner's approval. Purchase invoice (for vehicles attracting life time tax). Temporary registration if any. Valid insurance certificate. Address proof. Entry tax payment proof if any vehicle, body or tanker is purchased from outside the state. PAN number or Form-60 in two copies (expect 2 wheelers ). Manufacturers certificate for invalid carriage. Customs clearance certificate in case of imported vehicles along with licence & bond if any. Bill of entry for imported vehicles. Design approval from transport commissioner in the case of a trailer. 7/12 abstract or tahasildar certificate in the case of agricultural tractor & trailer. Fees Registration of vehicle arrived from outstate or assignment of new registration mark (R.M.A) If the vehicle is registered in one state and is kept or used in other state for the period of more than a year then the vehicle needs to be registered in the later state for a new registration number to be assigned . For this the NOC from original registering authority & consent of financier is needed to be furnished. Form - 20, 26, 27. Form 29, 30 - incase of transfer of ownership. Form 33 - incase of change of address only. NOC in form 28 with chassis print affixed on it from the original registering authority along with consent from financier. Form FT, AT. Form TCA, TCR - incase of transport vehicles only. Proof of payment of entry tax in case vehicle has arrived within 30 months of date of it's first registration. An affidavit from the owner of the vehicle stating that vehicle in concerned in not involved in any accident, theft or crime. Fees All valid documents of the vehicle.     Driving licence test is no more an easy ride, about 10% now fail to get through Mumbai: Gone are the days when acquiring a driving licence was a breeze. Recent data reveals that 10% of those appearing for permanent driving licence tests failed the test due to poor driving skills/knowledge while 25% failed to clear the learner’s licence test. “The figures show that we are not showing leniency towards any candidate and want to ensure that only those fit to drive vehicles get licences, ” said a senior transport official who did not wish to be named. An RTO official said: “We have directed the inspectors on field to conduct tests for every candidate. In the past, a few candidates from a driving school would appear for a test and the rest from the same school would pass arbitrarily.” Another RTO official said that in case of learner’s licence, the test was held through computerised system. “Nobody can cheat this system and so failure rate has gone, ” he said. On an average, 400 candidates appear for driving tests at the four city RTOs daily. Those appearing for tests have to first take the learner licence test and appear for the permanent driving test within six months. Activist G R Vora said this is a foolproof way of ensuring we get good drivers. “This way there will be transparency in system and will curb favouritism and corruption, ” Vora said, adding that in the past citizens used to get licences easily and it was just like getting a licence to kill people on the streets (in mishaps). “Driving tests should be made more stringent by introducing computerised test tracks at all the four RTOs in the city, ” he said. A proposal to set up such hitech test tracks was mooted a few years ago. If they come up, there will be no involvement of any RTO official or driving school agent during the test. Transport experts said it is more difficult to get a driving licence abroad. In the UK, the pass percentage was 47% a few years ago while in South Africa, it was 39% a few years back.     Maharashtra transport department plans RTO seva kendras at all RTO for driving license purposes. The department has invited bids for appointing a new service provider to process smart card driving licences. Aiming to give general public a better experience at its Regional Transport Offices (RTO), the transport department has planned to set up RTO seva kendras (service centres) on the lines of the passport seva kendra, at all 50 RTO offices across the state. The application process at RTOs is done online where Public has to come to RTO with this online application pre-done. Which public is not able to do in 70% of the cases and they take help of private non-professional agents outside RTOs and endup paying more. Though these agents are doing a very good job, but because of their unauthorized status and unorganized way of working, single man show.... lack of trust is the major problem in the minds of general public. The proposed RTO seva kendra setup will help those who are unable to apply online themselves at home or do not have internet access. And this service will be at a reasonable fixed price of not more than Rs. 100 (probably) Through RTOseva kendras, people could fill online applications, scan their documents and pay fees if they are unable to do it for outside. The transport department has already invited bids for appointing a new service provider to process smart card driving licences and setting up of the RTO seva kendras. The new service provider will set up a RTO seva kendra with at least two of its staffers at the front desk to attend the people at every RTO. The processing of driving licences includes data entry, scanning of documents, capturing photographs of applicant and printing smart cards, once the RTO approves the licences to applicants. RTO seva Kendra will process it, before dispatching those via post. Presently, people are dependent on Common Services Centers (CSC), set up for providing e-governance services which is a gross failer scheme. Recently, the transport department hiked their fees to ₹100 from ₹20. The fees at the proposed seva kendras will confirmed once the bid is finalized, but the transport department officials hinted that it will be less than ₹100. People will also be able to apply for a duplicate licence, make corrections to their licences or renew of licences through the proposed RTO seva kendras. The applications will be processed on a first come-first serve basis. RTO clerks won’t be able to process applications randomly as they do now, to allegedly favour agents. At the proposed seva kendras, the setup will be such that applicants will not have to visit the RTO office again. Except for tests, all other driving licence related work can be completed in a single visit. The contract period for the existing service provider which was appointed in 2007, is already over and the government has issued an extension period of six months. The new service provider will be appointed for a five-year period, as opposed to the 10-year contract previously given out. RTO seva Kendra's services are limited to driving licences only, there are no vehicle related services included in this tender. Public will have to still get TTO form filled outside only to get any vehicle ownership transfer or NOC. Parivahan section also has many problem areas, a similar service can streamline this as well. If not fully but urgent attention is to be given by transport department on giving RC book status online.

    The Rajasthan high court has directed the state government to cancel the licences of those caught talking on mobile phones while driving. It also directed the regional transport officers (RTOs) to initiate proceedings to cancel licences after providing the offenders opportunity for a hearing. A division bench of Justices Gopal Krishan Vyas and Ramchandra Singh Jhala issued the order on April 27 and sought a compliance report on May 22. “We are of the opinion that the drivers of four and two-wheelers are usually using mobile (phone) while plying the vehicles, which is not permissible under the law. More so, due to the said act of vehicle drivers, a number of accidents takes place, ” the court said in its order. The court further directed that if a driver is found using phone while plying the vehicle, “then after obtaining their photographs and other credentials, the same may be forwarded to the concerned RTO for cancellation of driving licence.” The transport department has been asked to initiate proceedings for cancellation of the driving licence strictly in accordance with law and after providing an opportunity for a hearing. Earlier, the Supreme Court committee on road safety had recommended suspension of driving licence for three months for five offences, including talking on mobile phone while driving. In India, use of mobile phone while driving is illegal under the Motor Vehicles Act. Prerna Singh, coordinator of Centre for Road Safety at Sardar Patel Police University, Jodhpur, said talking on mobile phones was a major danger to people’s lives on roads worldwide not just in India. “Use of mobile phone by even a pedestrian is bad for road safety, ” she added. Singh said that Rajasthan is probably the first state where the high court has issued such an order to ensure road safety.

    RTO undertakes drive against Royal Enfield with modified exhausts Kerala RTO claims to bring noise pollution under control with suspension of Registration Certificate of two wheelers with modified exhaust. Following our earlier report of Rajasthan High Court issuing orders to the local RTO to cancel driving licenses of those found talking on mobile phones while driving or riding, the Kerala RTO has now launched a campaign against Royal Enfield motorcycles with modified exhausts. Even as the Kerala Traffic Police have claimed that there are over 1, 000 bikes sporting loud exhausts in Ernakulam, the local RTO has promised stringent action against them. Many of these bikers own Royal Enfield and have been repeatedly receiving fines for this illegal act. The local RTO has now initiated suspension of RC – Registration Certificate for a period of 3 months during which time the bikers will not be allowed to ride their vehicles. Following the 3 month suspension period, offenders will have to take their bikes to the RTO for inspection. Once it is ascertained that this noise emitting exhausts have been replaced with a stock unit, then only will the RC be reissued. Bangalore police had confiscated hundreds of RE exhausts and crushed them under a road roller in a public display. This new campaign will be officially launched on 1st June 2018 and suspension of RC will be under Section 53 of Motor Vehicle Act, where in it clearly states that it is illegal to modify any part of a car or a motorcycle without permission from RTO. These modified silencers cause noise of around 95 dB to 100dB which is louder than a bus horn. These aftermarket exhaust systems are on offer through dealers across Kerala but these dealers cannot be held liable for sale of these exhaust system as they clearly indicate that these exhausts are exclusively for off road or competition use only.
