    Vehicle Registration Vehicle registration is compulsory to drive motor vehicle. No owner of a vehicle can allow or permit the use of unregistered vehicle. No dealer of motor vehicle can deliver unregistered vehicle to the purchaser. Vehicle is registered with Regional Transport Officer (RTO). There are three types of registration with RTO. They are as cited below: Temporary Registration Registration of New Vehicle Registration of vehicle arrived from outstate or assignment of new registration mark (R.M.A) Let us discuss the above three separately: Temporary Registration To take vehicle from the dealer's premises, it needs a temporary registration. In case of non-transport vehicles, to take the vehicle to the place of registration from the dealer's premises it needs to be registered temporarily. In case of transport vehicle one needs a time to construct the body of vehicle over the chassis hence it needs a temporary registration. Temporary registration is valid for 7 days initially and can be extended up to 30 days incase of non transport vehicles. The validity can be extended for some more period with the permission of registering authority in case of transport vehicles. An application for temporary registration shall be made. Registration of New Vehicle To apply for the permanent registration of new vehicle, it should be produced to the RTO for inspection. The vehicle is inspected by an inspector who confirms to the provision of Act & rule and then the vehicle tax is recovered. Along with this the following is to be submitted: Form -20 Sale certificate in form 21 given by dealer. Roadworthiness certificate in form 22 , 22-A from the manufacturer. Roadworthiness certificate in form 22-A part II from the body builder for transport vehicles. Transport commissioner's approval. Purchase invoice (for vehicles attracting life time tax). Temporary registration if any. Valid insurance certificate. Address proof. Entry tax payment proof if any vehicle, body or tanker is purchased from outside the state. PAN number or Form-60 in two copies (expect 2 wheelers ). Manufacturers certificate for invalid carriage. Customs clearance certificate in case of imported vehicles along with licence & bond if any. Bill of entry for imported vehicles. Design approval from transport commissioner in the case of a trailer. 7/12 abstract or tahasildar certificate in the case of agricultural tractor & trailer. Fees Registration of vehicle arrived from outstate or assignment of new registration mark (R.M.A) If the vehicle is registered in one state and is kept or used in other state for the period of more than a year then the vehicle needs to be registered in the later state for a new registration number to be assigned . For this the NOC from original registering authority & consent of financier is needed to be furnished. Form - 20, 26, 27. Form 29, 30 - incase of transfer of ownership. Form 33 - incase of change of address only. NOC in form 28 with chassis print affixed on it from the original registering authority along with consent from financier. Form FT, AT. Form TCA, TCR - incase of transport vehicles only. Proof of payment of entry tax in case vehicle has arrived within 30 months of date of it's first registration. An affidavit from the owner of the vehicle stating that vehicle in concerned in not involved in any accident, theft or crime. Fees All valid documents of the vehicle.     Now, Centre to link driving licence withAadhaar to weed out fake ones The Centre is in the process of linking driving licences with Aadhaar Number to weed out fake licences and a software for this covering all states on a real-time basis is under preparation, the Supreme Court was told on Wednesday. A bench comprising Justices Madan B Lokur and Deepak Gupta was informed about it by a court-appointed committee on road safety headed by former Supreme Court Judge Justice K S Radhakrishnan. This assumes significance as a five-judge Constitution bench headed by Chief Justice Dipak Misra is currently hearing a clutch of petitions challenging the constitutional validity of the Aadhaar scheme and the enabling 2016 law. The committee, in its report filed in the top court, said it had held a meeting on November 28 last year with the joint secretary of Ministry of Road Transport and Highways (MoRTH) to discuss several issues, including procurement of fake licences and how to eliminate it. "On the issue of fake licences, joint secretary, MoRTH informed that NIC (national informatics centre) is now preparing 'Sarthi-4' under which all the licences would be linked to Aadhaar, " the report said. "This software will cover all the states on real-time basis and it will not be possible for anyone to get a duplicate or fake licence anywhere in the country, " it said. The advocate representing the committee told the bench that the panel was scheduled to have a meeting with the MoRTH and other authorities concerned on February 22-23 to discuss compliance of directions given by the apex court earlier. Additional Solicitor General Pinky Anand, appearing for the ministry, told the bench that fatalities in road accidents in India have gone down by around three percent in 2017 as compared to 2016. The bench said it was "heartening to know" that number of fatalities and injuries in road accidents have come down. In its report, the committee said it had asked states and union territories (UTs) to forward road accident data for entire 2017. "The committee has since received data from all the states/UTs, except Arunachal Pradesh, Manipur, Mizoram and Daman and Diu which indicates that in the states/UTs which have submitted data, there has been a reduction of 4, 558 fatalities (i.e. 3.0 per cent) and 24, 023 injuries (i.e. 5.0 per cent) in 2017 as compared to 2016, " the report said. The committee told the court that through its November 24 last year letter, it had asked all the states to set up a road safety fund which would be non-lapsable and to have a steady flow of funds by the diversion of "significant" portion of fines collected from traffic violations. It said some states have already set up road safety fund and the committee was pursuing the issue with remaining states in order to ensure full compliance of the apex court's order which had said that the fund should be established by March 31, 2018. The report said at the November 28 last year meeting, it was discussed that since driving licences were now in the form of a smart card, its punching in cases of default was likely to damage the data stored in it. "Joint Secretary MoRTH pointed out that presently NIC is in the process of developing central computerised data base and all the states would be covered under the same. "This data base is likely to be effective from October 1, 2018, " it said, adding, that all the offences committed by the driver would be recorded in this data base and there would be no necessity for punching of driving licences. The committee further said that 20-25 per cent fatalities on roads occur due to non-existence of pedestrian facilities, like footpaths, over-head passes, and under-passes and so it has asked the states to provide pedestrian facilities in accordance with the Indian Road Congress (IRC) guidelines. The court, while posting the matter for hearing on April 23, said that the committee should ensure compliance of its directions given earlier. The apex court had in November last year issued a slew of directions on road safety and asked all states and UTs to set up a trauma centre in each district of the country and make safety norms part of school curriculum. It had also directed that road safety education and counselling be made a part of school curriculum by the state boards by April 1, 2018, and at least one trauma care centre be set up in every district with an ambulance.     Government Approves Green License Plates for E-Vehicles The government also plans to allow youth in the age bracket of 16-18 years to drive electric scooters, besides mandating taxi aggregators to have a certain percentage of the e-vehicle fleet To promote electric vehicles in India, the government has approved green license plates bearing numbers in white fonts for private e-vehicles and yellow for taxis, Union Minister Nitin Gadkari said today. The government also plans to allow youth in the age bracket of 16-18 years to drive electric scooters, besides mandating taxi aggregators to have a certain percentage of the e-vehicle fleet. "The government has approved distinctive green license plates for electric vehicles to encourage people to use electric vehicles. Such vehicles will be fitted with green license plates bearing numbers in white fonts for private cars and yellow font for taxis, " Gadkari said. A notification in this regard will be out in a week's time, the minister, who has been advocating electric mobility promotion, he said. The purpose behind distinctive number plates is their easy identification for preferential treatment in parking, free entry in congested zones besides other proposed benefits like concessional toll, the road transport, and highways minister told PTI. The measure is aimed at promoting vehicle's use and the government is considering an exemption from permits for such vehicles. "Exemption from permit will be a game changer as restricted permit regime is a major concern. E-rickshaw growth is attributable to the permit exemption and there is scope to extend the exemption to the e-buses, e-taxis, e-autos, and e-bikes. E-auto and e-buses may have a big impact since getting a new permit is extremely difficult, " the minister said. Similarly, e-bikes also should see a considerable impact since it is a new area, he added. Besides, the government is contemplating permitting youth in the age group of 16-18 years to drive e-scooters, which are gearless and this will lead to a big demand for e-scooters, the minister noted. Under the Motor Vehicles Act, 1988, those in the age group of 16-18 years are granted a licence for below 50 CC gearless scooters. Incidentally, there is no scooter in this category made in the country. "The government is also contemplating to ask taxi aggregators to have an incremental share of electric vehicles from 2020 onwards, which could be 1 percent of the fleet every year, " Gadkari said. Similarly, all public transport operators may also be mandated to provide 1 percent incremental fleet from 2020 onwards, he added. Stressing that electric vehicles will bring down vehicular pollution, Gadkari said the government is tightening fuel efficiency norms. Besides, Ministry of Road Transport and Highways will request the finance ministry that the rate of depreciation on EVs may be allowed at 50 percent as against the rate of 15 percent for conventional vehicles. The proposals include bringing down the GST on batteries to 12 percent at par with the GST on EVs. As per an estimate, India at present has 1 to 1.5 lakh electric vehicles and it is projected to grow to about 5 percent of the total vehicles in the next five years, an official said. Of the about 24 million vehicles sold in India in 2017-18, electric vehicles accounted for barely about 1 percent, the official added. India, currently, has four kinds of number plates - white licence plates with numbers on black font for private cars, yellow plates with fonts in black for commercial vehicles, black plates with yellow font letters for self-driven rental vehicles and blue plates with white font letters for Embassies and High Commissions.     RTO undertakes drive against Royal Enfield with modified exhausts Kerala RTO claims to bring noise pollution under control with suspension of Registration Certificate of two wheelers with modified exhaust. Following our earlier report of Rajasthan High Court issuing orders to the local RTO to cancel driving licenses of those found talking on mobile phones while driving or riding, the Kerala RTO has now launched a campaign against Royal Enfield motorcycles with modified exhausts. Even as the Kerala Traffic Police have claimed that there are over 1, 000 bikes sporting loud exhausts in Ernakulam, the local RTO has promised stringent action against them. Many of these bikers own Royal Enfield and have been repeatedly receiving fines for this illegal act. The local RTO has now initiated suspension of RC – Registration Certificate for a period of 3 months during which time the bikers will not be allowed to ride their vehicles. Following the 3 month suspension period, offenders will have to take their bikes to the RTO for inspection. Once it is ascertained that this noise emitting exhausts have been replaced with a stock unit, then only will the RC be reissued. Bangalore police had confiscated hundreds of RE exhausts and crushed them under a road roller in a public display. This new campaign will be officially launched on 1st June 2018 and suspension of RC will be under Section 53 of Motor Vehicle Act, where in it clearly states that it is illegal to modify any part of a car or a motorcycle without permission from RTO. These modified silencers cause noise of around 95 dB to 100dB which is louder than a bus horn. These aftermarket exhaust systems are on offer through dealers across Kerala but these dealers cannot be held liable for sale of these exhaust system as they clearly indicate that these exhausts are exclusively for off road or competition use only. While many developed nations allow a restricted driving licence at an earlier age, in India an individual had to be at least 18 years old to apply for a license. Well, this can be a thing of past as the government is working on a new rule to allow teenagers of age 16 and above to ride legally. The union ministry is working on a proposal to grant driving licenses to 16-18 years old. People belonging to the age group can apply for a formal license that will allow them to ride gearless scooters with up to 100cc capacity. The new rule is being considered after the growing trend of teenagers using such gearless scooters illegally. And non availability of 50cc mopeds like luna and Vickie's of previous years. A group of state transport ministries recommended the new rule to the union government in 2016. Interestingly, the Central Motor Vehicles Act allows the 16-18 years old teens to apply for a license but the restriction is 50cc gearless scooters. There is no such scooter available in the Indian market till now, which forced the group of ministers to bring it to the government’s notice. The new ruling will allow many teenagers to ride legally in India. There are numerous gearless scooters below 100cc in the Indian market that will serve the purpose of the amendment. However, for two-wheelers above 100cc, geared two-wheelers and light motor vehicles, an individual will have to wait till 18 years of age. After various state cops started to enforce underage driving rules strictly, many parents were arrested for allowing their underage children to drive or ride. The new law will give such parents a breather. It will also allow the insurance companies to compensate for any incidents if an individual aged between 16-18 years with a valid license is riding a gearless scooter under 100cc.     In Thiruvananthapuram, Green tax not a deterrent for owners of old vehicles Green Tax was proposed in the state budget 2016-17, for private vehicles having four or more wheels, which are older than 15 or more years, and transport vehicles having four or more wheels and are older than 10 or more years. Thiruvananthapuram regional transport office of motor vehicles department earned nearly Rs 1 crore as Green Tax, since its introduction in January 1, 2017. The tax was introduced with the aim of discouraging the use of old vehicles. But it seems that the initiative has failed to serve its purpose. Green Tax was proposed in the state budget 2016-17, for private vehicles having four or more wheels, which are older than 15 or more years, and transport vehicles having four or more wheels and are older than 10 or more years. The number of vehicles for which Green Tax was paid at Thiruvananthapuram RTO in the first quarter of 2018 is higher, when compared the number of vehicles for which the tax was paid in 2017. For a total of 1, 255 vehicles Rs 4, 79, 100 was paid as Green Tax at RTO office in 2017, while an amount of Rs 4, 99, 600 was collected from 1, 410 vehicles this year till May 4. The finance minister has declared that the government expects additional revenue of Rs 7 crore every year through the tax. Green Tax charged for private vehicles with four or more wheels at the time of renewal of registration is Rs 400. At the time of renewal of fitness certificate light transport vehicles having four or more wheels are charged Rs 200, for medium transport vehicles Rs 300 is charged and heavy transport vehicles will have to pay Rs 400. The government had exempted motor cycles and vehicles with three wheels from Green Tax. “Only a nominal amount is collected as Green Tax. More stringent measures such as inclusion of all categories of vehicles under the tax are needed to control vehicular pollution, ” said an official from Thiruvananthapuram RTO. Meanwhile, MVD had identified 66 vehicles plying in the district, which are registered under bogus addresses in Pondicherry. Among these, 26 vehicle owners have paid for re-registration of the vehicles at Thiruvananthapuram RTO. An amount of Rs 1, 71, 22, 040 was received in this regard from the vehicle owners. Since, the deadline on amnesty scheme proposed by the government for owners of high-end vehicles registered under bogus addresses in other states, ended on April 30, MVD will proceed with legal steps and seizure of these vehicles

    How to Know If your PAN Card Is Active Or Not Government of India is taking strong steps towards eradicating fake Pan Cards in the country and now it is going to deactivate almost 11, 44, 211 PAN Cards by July 2018. It is an offense to carry more than one PAN number registered under his/her name. If submitted any wrong or inactive or duplicate PAN in RTO and caught there is a heavy penal action on the individual. Central Government has identified several PAN cards registered under non-existing people who have given false information about themselves for PAN. Govt has released an official statement as " The uniqueness of PAN is achieved by conducting a de-duplication check on all already existing allotted PAN against the data furnished by the new applicant. Under the existing system of PAN, only demographic data is captured" Indian Citizen cannot hold more than one PAN. A penalty of Rs. 10, 000 is liable to be imposed under section 272B of the Income-tax Act, 1961 for having more than one PAN. If a person has been allotted more than one PAN then he should immediately surrender the additional PAN card(s). Government said it is important for everyone to check if their PAN CARD status is still active and has asked everyone to link their PAN Cards with the AADHAR Card before 31st Aug 2018. How to Check your Pan Card Status - Steps here :- 1- Log on to incometaxindiaefiling.gov.in 2- In the Left-hand column, in the SERVICES tab click on ‘KNOW YOUR PAN’ option 3- Once you click on the ‘know your pan’ option, it will land you in another page wherein you need to give your personal details- name, status, dob, contact number. 4- You will receive an OTP on your mobile nb, you need to enter the OTP on the page you land to. 5- Enter the OTP and hit ‘Validate’ If there are more than one PAN cards registered with the details provided, you will see a pop message saying “There are multiple records for this query. Provide additional information.” Enter some more details such as your father’s name. If your PAN number is not duplicate, you will receive a message ACTIVE under Remarks column which means your PAN Card is still active.
